Save the Date
Effective Date: March 15, 2026
TL;DR
Save the Date records your dates (with both people's consent), generates private AI feedback for each person, then permanently deletes the audio and transcript. You must be 18+, you must get your date's consent before recording, and you can't use the app for anything illegal or harmful. We're a Georgia LLC, Georgia law applies, and disputes go through arbitration in Atlanta. The service is provided "as is" during beta. If you break these rules, we can suspend your account.
1. Agreement to Terms
By downloading, accessing, or using the Save the Date mobile application or website at getsavethedate.com (together, the "Service"), you agree to be bound by these Terms of Use ("Terms"). The Service is operated by You're Telling Me There's a Chance, LLC, a Georgia limited liability company doing business as Save the Date ("we," "us," or "our"). If you do not agree to these Terms, do not use the Service.
2. Eligibility
You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18, that you have the legal capacity to enter into a binding agreement, and that your use of the Service does not violate any applicable law or regulation.
3. What the Service Does
Save the Date is a mutual reflection tool for people who are dating. Here's how it works:
- Recording. With the consent of both you and your date, the app records your in-person conversation through your device's microphone.
- AI Analysis. The recording is transcribed and analyzed by artificial intelligence to generate personalized, private insights about the conversation for each participant.
- Deletion. Once insights are generated, the audio recording and the transcript are permanently deleted from our servers. You receive a deletion receipt confirming this. Only the AI-generated insights are retained.
- Insights. Each participant receives their own private set of insights. You will never see your date's insights, and they will never see yours.
4. Consent Requirements — This Is Critical
You are responsible for obtaining your date's informed consent before activating a recording. This is not optional. Georgia is a one-party consent state for audio recordings under O.C.G.A. § 16-11-66, meaning that legally only one party to a conversation needs to consent. However, Save the Date requires both parties to consent as a condition of using the Service.
We require mutual consent because: (a) it's the right thing to do; (b) it builds trust between you and your date; and (c) it ensures both people know they'll receive feedback. The app provides tools to help you invite your date and obtain their consent, including a shareable link where your date can review what the app does and opt in or decline.
If you activate a recording without your date's consent, you are violating these Terms. We may suspend or terminate your account, and you may be exposing yourself to legal liability depending on where the recording takes place. Some states and countries require all-party consent for recordings. It is your responsibility to know the laws that apply to you.
5. Your Account
You may need to create an account to use certain features. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to notify us immediately at hello@getsavethedate.com if you believe your account has been compromised.
6. Acceptable Use
You agree not to use the Service to:
- Record anyone without their knowledge and consent
- Record minors (anyone under 18) under any circumstances
- Record conversations in settings where recording is prohibited by law or policy (e.g., certain workplaces, government buildings)
- Harass, stalk, intimidate, or harm another person
- Use insights generated by the Service to manipulate, coerce, or deceive another person
- Attempt to extract, reconstruct, or reverse-engineer the audio or transcript after deletion
- Interfere with or disrupt the Service, its servers, or its networks
- Violate any applicable local, state, national, or international law
7. Intellectual Property
The Service, including its design, features, AI models, branding, and content (other than user-generated content), is owned by You're Telling Me There's a Chance, LLC and protected by U.S. copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms.
You retain ownership of any insights generated from your dates. However, you grant us a limited license to use anonymized, aggregated data derived from the Service to improve our AI models and product. This data will never be traceable back to you or your date.
8. AI-Generated Content Disclaimer
The insights and feedback provided by Save the Date are generated by artificial intelligence. They are not professional advice of any kind—not psychological, therapeutic, legal, or otherwise. AI can make mistakes, misinterpret tone or context, and draw incorrect conclusions. You should treat the insights as one perspective among many, not as authoritative truth. We are not responsible for decisions you make based on AI-generated feedback.
9. Beta and Early Access
The Service is currently in beta. This means features may change, break, or be removed without notice. We may limit access, reset data, or modify the Service at any time during the beta period. Beta access is free, but we reserve the right to introduce paid features or subscriptions in the future.
10. Termination
We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice. You may also stop using the Service at any time. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (including Sections 7, 8, 11, 12, 13, and 14) will survive.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. To the fullest extent permitted by Georgia law and federal law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any insights will be accurate or useful.
12. Limitation of Liability
To the maximum extent permitted by applicable law, You're Telling Me There's a Chance, LLC, its members, managers, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to damages arising from: AI-generated insights or feedback; reliance on the Service for relationship decisions; unauthorized recording or misuse of the Service by other users; or data loss or security breaches.
Our total liability to you for all claims arising out of or related to these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) fifty dollars ($50.00).
13. Dispute Resolution and Arbitration
Please read this section carefully. It affects your legal rights.
Informal Resolution First. Before filing any formal proceeding, you agree to contact us at hello@getsavethedate.com and attempt to resolve the dispute informally for at least thirty (30) days.
Binding Arbitration. If informal resolution fails, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. Arbitration will take place in Atlanta, Georgia (Fulton County). The arbitrator's decision will be final and enforceable in any court of competent jurisdiction.
Class Action Waiver. You and Save the Date agree that any arbitration or court proceeding shall be conducted only on an individual basis and not as a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, both parties waive any right to a jury trial.
Small Claims Exception. Either party may bring an individual action in small claims court in Fulton County, Georgia, if the claim qualifies.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict-of-law principles. To the extent that litigation is permitted under these Terms, the exclusive venue shall be the state and federal courts located in Fulton County, Georgia.
15. Indemnification
You agree to indemnify, defend, and hold harmless You're Telling Me There's a Chance, LLC and its members, managers, employees, contractors, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third party's rights, including any recording or privacy laws; or (d) your failure to obtain proper consent before recording.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. If you don't agree to the new Terms, stop using the Service.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be enforced to the maximum extent possible, and the remaining provisions will remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and You're Telling Me There's a Chance, LLC regarding the Service and supersede all prior agreements and understandings.
